Welcome to JobApplAI ("Company", "We", "Us", or "Our"). These Terms of Service ("Terms") govern your access to and use of our web application, career tools, resume templates, future browser extensions, and related artificial intelligence services accessible via https://job-appl-ai.vercel.app/ and any associated subdomains (collectively, the "Service").

By registering an account, logging in using Google Sign-In (OAuth), or using our Service in any capacity, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease all access to and use of our Service.

1. Eligibility and Accounts

1.1 Age Requirement

You must be at least 16 years of age to create an account and use this Service. By accessing or using JobApplAI, you warrant and represent that you are at least 16 years of age and have the full legal capacity to enter into a binding contract under applicable local laws.

1.2 Account Registration and Google Authentication

To access the core features of the Service — including managing Master Resumes, generating tailored resumes and cover letters, accessing gap analysis metrics, and utilizing the application tracker — you must register for an account.

For your convenience and enhanced security, we support account registration and authentication through Google Sign-In (OAuth). When you authenticate your account via Google, you grant us permission to access specific, basic profile information (such as your primary email address, full name, and profile picture) as detailed in our Privacy Policy. Your use of Google's services is subject to the Google Terms of Service and Google Privacy Policy.

1.3 Account Security

You are entirely responsible for:

• Maintaining the security, privacy, and confidentiality of your credentials.
• All uploads, edits, tailoring tasks, and activities that occur under your account.

You must notify us immediately at jobapplai@gmail.com if you suspect any unauthorized access, breach, or compromise of your account's security.

2. Description of Service & User Content

2.1 Scope of Service

JobApplAI operates as an intelligent Software-as-a-Service (SaaS) career management assistant. The Service includes, but is not limited to, the following core modules:

• User Profile & Asset Management: Creating, parsing, organizing, and editing modular resume text blocks (Experience, Education, Skills, Projects) inside one or more "Master Resumes" which act as your career source of truth.
• Application & Tailoring Engine: Uploading Job Descriptions (JDs) to run simultaneous AI-powered resume tailoring and gap analyses, generating highly relevant tailored content rendered inside customizable HTML templates, and exporting finalized materials via browser-based print-to-PDF tools.
• Cover Letter Generation: Creating customized cover letters based on Master Resume data, job requirements, and user-specified tone settings.
• Application Tracker: Organizing, monitoring, and updating active job applications through a digital dashboard list view.
• Deep Research and Outreach (Future Scope): Compiling company, team, salary, and outreach stakeholder insights using web search agents.
• Interview Prep Suite (Future Scope): Simulating mock interviews using text guides and interactive, audio-based roleplays requiring speech-to-text (STT) and text-to-speech (TTS) processing.
• Browser Extension (Future Scope): Scraping JD data directly from supported third-party job boards to create instant application tracking cards in the web app.

2.2 Your Content (Input)

You retain all intellectual property rights and full ownership over any text, files, resume documents, employment histories, achievements, or custom instructions you upload, paste, or submit to the Service ("User Content").

By submitting User Content to the Service, you grant JobApplAI a worldwide, non-exclusive, royalty-free, fully paid-up license to host, store, process, reproduce, and transmit your content solely for the purpose of delivering, optimizing, protecting, and improving the Service for you. This includes transmitting your text inputs to secure, commercial AI sub-processors for real-time profile evaluation, resume tailoring, cover letter drafting, and voice feedback execution.

2.3 Acceptable Use

You agree that you will not, under any circumstances:

• Upload resumes, experience entries, or application materials containing false, fraudulent, or deceptive certifications, credentials, or statements.
• Use our AI engine to generate spam, abusive materials, malicious cover letters, or to automate mass-application submissions in violation of third-party job board guidelines.
• Attempt to reverse engineer, decompile, scrape, data-mine, or extract the source code, underlying UI assets, or system-level AI prompts of JobApplAI.
• Abuse, overload, bypass, or exploit rate limits established on the platform's AI Application Programming Interfaces (APIs).

2.4 Newsletter Signup

You may optionally provide your email address via the newsletter signup form on our homepage to receive occasional job search tips, AI career insights, and platform updates. Subscribing to the newsletter is not a required condition for using the Service and does not create a binding obligation on your part beyond consenting to receive email communications. You may unsubscribe at any time.

3. Disclaimers Concerning AI-Generated Output

3.1 Review, Verification, and Accuracy

JobApplAI utilizes third-party commercial large language models (LLMs) to perform resume analysis, tailoring, gap scoring, cover letter generation, and interview feedback. AI-generated output is subject to computational errors, discrepancies, and logical "hallucinations." You explicitly acknowledge and agree that:

• Final Material is Your Sole Responsibility: You must carefully review, edit, verify, and approve all tailored resumes, HTML previews, cover letters, and application answers before downloading them or submitting them to any employer, recruiter, or third-party entity.
• No Validation of Factual Truth: JobApplAI does not verify, audit, or certify the factual truth of your generated documents or your uploaded master materials. You are exclusively responsible for ensuring all skills, work histories, project dates, and experiences presented in your final applications are truthful and accurate.

3.2 No Guarantee of Employment Outcomes

JobApplAI is an assistive tool built to help you optimise and organize your job application materials. We make no representations, warranties, or guarantees that using the Service will result in securing interviews, passing screening filters, obtaining job offers, scoring successfully on admissions evaluations, or achieving any employment placement. Your professional success remains dependent on external job market conditions, your qualifications, and final decisions made by third-party recruiters and employers.

4. Subscription Fees, Payments, and Billing

4.1 Subscription Tiers

We may offer both free-tier access (with limited tailoring tasks) and premium, paid subscription plans (providing pro tailoring, unrestricted gap analysis, advanced templates, and priority processing). Features, usage limits, and fees for each subscription tier are explicitly detailed on our platform pricing page.

4.2 Secure Payment Processing via Stripe

All subscription payments, transaction handling, and billing renewals are securely processed through our third-party payment partner, Stripe.

By upgrading to a paid subscription tier, you authorize Stripe to charge your designated payment method for the fees associated with that tier, including any applicable transaction taxes or local levies.

You are responsible for keeping your billing credentials and payment methods up-to-date within your Stripe customer billing portal.

JobApplAI does not receive, view, or store your raw payment details (e.g., credit card numbers or CVV codes).

4.3 Automatic Renewal and Cancellation Policy

Automatic Renewal: Unless otherwise stated at the time of purchase, paid subscriptions automatically renew at the end of each billing cycle (monthly or annually) under the same pricing terms.

Cancellation: You may cancel your subscription at any time through your Account Settings page. Cancellation prevents future automatic renewals. Your premium access will continue uninterrupted until the end of your current paid billing period, at which point your account will revert to the free tier.

Refund Policy: Except as required by applicable legislation — including statutory consumer protections under the Australian Consumer Law — all payments are strictly non-refundable. We do not provide prorated refunds, credits, or fee adjustments for partial billing periods or unused account features.

5. Platform Intellectual Property

The Service — including its software code, user interface designs, visual layouts, platform logos, trade names, system architecture, tailored resume templates, proprietary text-matching algorithms, and system prompts — is the exclusive intellectual property of JobApplAI and is protected by copyright, trademark, and other intellectual property laws of Australia and international jurisdictions.

We grant you a limited, non-exclusive, non-transferable, revocable, personal license to access the platform, customize HTML resume templates, and download your finalized resumes, cover letters, and tracking histories as PDF documents solely for your personal career purposes. You are strictly prohibited from copying, distributing, selling, or licensing our structural HTML templates for commercial resale or compiling them into competitive services.

6. Limitation of Liability and Indemnification

6.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBAPPLAI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE.

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW (INCLUDING STATUTORY RIGHTS ENFORCED UNDER THE AUSTRALIAN CONSUMER LAW), IN NO EVENT SHALL JOBAPPLAI, ITS DIRECTORS, EMPLOYEES, CONTRACTORS, OR AI SUB-PROCESSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF REVENUE, LOST JOB OPPORTUNITIES, DATA LOSS, REPUTATIONAL DAMAGE, OR BUSINESS INTERRUPTION ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO THE COMPANY FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

6.3 Indemnification

You agree to defend, indemnify, and hold harmless JobApplAI, its affiliates, officers, directors, and employees from and against any claims, damages, liabilities, losses, costs, or legal expenses (including reasonable attorney fees) arising from:

• Your violation or breach of these Terms.
• Your User Content, including false or fraudulent statements contained on resumes or cover letters that you distribute to third-party employers.
• Your infringement or violation of any third-party intellectual property, privacy, or legal rights.

7. Account Suspension and Termination

We reserve the right, in our sole discretion, to suspend, restrict, or terminate your account and block your access to the Service at any time, without prior notice or liability, for reasons including:

• A material breach or violation of these Terms.
• Suspected fraudulent, illegal, abusive, or malicious behavior.
• Outstanding or failed payment of subscription fees.

Upon termination, your right to access and use the Service will immediately cease. If you wish to close your account and request the permanent deletion of all stored resume databases, tracking histories, and profile elements, you can perform this action directly within your Account Settings or contact us for assistance at jobapplai@gmail.com.

8. Governing Law and Dispute Resolution

These Terms and your use of the Service shall be governed by, and construed in accordance with, the laws of Victoria, Australia, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, including its validity or termination, shall first be addressed through amicable, good-faith negotiation. If a mutual resolution cannot be reached within thirty (30) days of notifying the other party, the dispute shall be submitted to and settled under the exclusive jurisdiction of the state and federal courts located in Victoria, Australia.

9. Changes to These Terms

We reserve the right to modify, update, or replace these Terms at our discretion. We will post revised Terms on this webpage and update the "Last updated" date at the very top of this document.

For material changes that significantly affect your rights or obligations under these Terms, we will notify you by sending a direct notification to your registered email address or by placing a prominent alert within our web application interface prior to the changes taking effect.
